1. About These Terms

These Terms and Conditions ("Terms") govern your use of the CarAdvisor website and iOS application (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who We Are

CarAdvisor ("we", "us", "our") is operated by an individual. For support, contact support@caradvisor.uk.

3. The Service

CarAdvisor helps you view MOT history and related vehicle information by entering a UK vehicle registration number. The Service may also provide AI-generated vehicle analysis and insights ("AI Analysis"), estimated running-cost information (such as estimated vehicle tax), Clean Air Zone information, and features to save lookups (History) and vehicles (Garage), which are stored on your device and may sync across your devices via your private iCloud account. You may optionally create an account, and some features may require the purchase of credits.

4. Information Sources and Accuracy

The Service displays information obtained from third-party sources, including official UK government data services such as DVSA (MOT history) and DVLA (vehicle information services, where applicable). We do not control those sources and cannot guarantee that all information is accurate, complete, or up to date. You should independently verify critical information (for example, before purchasing a vehicle).

5. Estimates and Inferred Information

Some information shown in the Service is calculated, estimated, or inferred by us rather than provided directly by an official source. This includes, for example, estimated vehicle tax (VED) figures, inferred Euro emissions standards, Clean Air Zone compliance indications, mileage averages, and similar derived figures. These are estimates only, may be wrong for a particular vehicle, and must not be relied upon. Always check official sources (such as GOV.UK) for authoritative figures before making any decision.

6. AI-Generated Content

AI Analysis and similar features are generated automatically by third-party artificial intelligence models based on limited, summarised data about a vehicle. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, out of date, or misleading, and may contain errors or fabricated information.
• AI Analysis is not an inspection of the actual vehicle. It is generated from records and general knowledge, not from any physical examination, and cannot detect the true condition of a specific vehicle.
• Any scores, ratings, risk indicators, or recommendations are automatically generated opinions, not statements of fact and not advice.
• We do not review, verify, or endorse AI-generated content, and we make no representations or warranties of any kind about it.
• You use AI-generated content entirely at your own risk and must independently verify anything you intend to rely on.

7. No Professional Advice; Your Decisions Are Your Own

The Service (including AI Analysis) is provided for general informational purposes only. It does not constitute, and must not be treated as, mechanical, engineering, safety, legal, financial, insurance, or other professional advice, and it is not a recommendation or endorsement to buy, sell, or avoid any vehicle.

You must not use the Service as the basis for a decision to purchase, sell, or otherwise deal in a vehicle. Before buying any vehicle you should, at a minimum, arrange an independent inspection by a qualified mechanic, obtain a full vehicle history/provenance check, and verify all information directly with official sources. Any decision you make - including any decision to purchase, sell, insure, finance, repair, drive, or not drive a vehicle - is made solely by you and at your own risk. To the fullest extent permitted by law, we accept no responsibility and shall have no liability for any such decision or its consequences.

8. Accounts

You may optionally create an account (for example, using Sign in with Apple). If you do:

• You must provide accurate information and keep it up to date.
• You are responsible for your account and for keeping access to your device and sign-in method secure.
• You must be at least 16 years old (or the age of digital consent in your jurisdiction) to create an account.
• We may suspend or terminate accounts that breach these Terms or where reasonably necessary to protect the Service or other users.
• You can delete your account at any time in the app's settings. Deleting your account removes your account data as described in our Privacy Policy.

9. Credits and Purchases

Certain features may require credits or other in-app purchases. Where offered:

• Purchases are processed by Apple through the App Store and are also subject to Apple's terms. We do not receive your payment card details.
• Credits are a limited, non-transferable licence to use the relevant features. They have no monetary value, cannot be exchanged for cash, and may not be resold.
• Refunds, where available, are handled through Apple in accordance with App Store policies and applicable consumer law.
• We may change the pricing of credit packages or the number of credits a feature requires. Changes will not affect credits you have already purchased being usable for their stated purpose, but we may modify or discontinue features as described in section 14.

10. Acceptable Use

You agree not to:

• Use the Service unlawfully or in a way that infringes others' rights.
• Attempt to bypass or interfere with security, rate limits, credit requirements, authentication, or access controls.
• Reverse engineer, scrape, harvest, or bulk-collect data from the Service except as permitted by law.
• Use the Service to facilitate fraud or misrepresentation.

11. Your Data (History/Garage)

If you use History or Garage features, data may be stored locally on your device and synced via your private iCloud (CloudKit) database. You are responsible for managing your device, your iCloud account, and their security settings. You can remove this data by deleting entries in the app.

12. Third-Party Services

The Service relies on third-party services, including government data providers (DVSA, DVLA), cloud hosting, AI model providers, Apple (sign-in, iCloud sync, and purchases), and app analytics/crash reporting/feedback providers. Those third parties may have their own terms and privacy policies. We are not responsible for third-party services that are not operated by us.

13. Intellectual Property

We and our licensors own all rights, title, and interest in the Service, including its software and content, except where otherwise stated. You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission or applicable law allows it.

14. Availability and Changes

We may change, suspend, or discontinue any part of the Service at any time, including features, AI Analysis, and availability of data sources. We do not guarantee uninterrupted access.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties and representations, express or implied, including accuracy, reliability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, we make no warranty that any information, estimate, or AI-generated content in the Service is accurate, complete, or suitable for any purpose, including assessing whether to purchase a vehicle.

16. Limitation of Liability

Nothing in these Terms limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or your statutory rights as a consumer.

Subject to that, to the fullest extent permitted by law:

• We will not be liable for indirect, incidental, special, or consequential losses, or for loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service.
• We will not be liable for any loss or damage arising from the purchase, sale, ownership, condition, use, or performance of any vehicle, or from any decision made or action taken (or not taken) in reliance on the Service, including information sourced from third parties, our estimates, and AI-generated content.
• We will not be liable for inaccuracies or omissions in data provided by third-party sources or generated by AI models.

18. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above. Continued use of the Service after changes means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where mandatory consumer protection laws provide otherwise.
